Variants of ex-works conditions.
EXW EX Works (from the factory) - means that the seller delivers the goods at the buyer's disposal (for example, at a factory or warehouse), whereby the place of delivery does not have to be the seller's premises. However, it is recommended that the parties specify as precisely as possible a specific point within the designated place of delivery.
Ex-works (specified place) I
With the 'Ex-works' option, the seller minimises his risk and liability. The buyer loads the goods, organises and pays for transport, customs clearance and insurance. The buyer picks up the goods from a specific location, usually the seller's factory or warehouse. The buyer must organise and pay for the transport, once the delivery has been taken, and is responsible for the goods from that point onwards. The buyer bears all risks and costs of transport.
The seller's liability is limited to making the goods available at his premises or a designated place. The seller must place the goods at the disposal of the buyer at this location and must bear the costs until the goods are made available. Once the goods have been made available, he has no further liability.
Ex-works (specified place) II
The seller is obliged to deliver conforming goods, weighed, checked, measured (if necessary) ready for delivery and to provide the invoice and all necessary documents proving conformity. Where applicable, the seller is obliged to provide packaging at his own expense. The seller is obliged to provide any assistance required by the buyer in confirming conformity and to provide documents required to facilitate export.
The buyer is required to obtain the relevant licences and permits for export and to complete and pay customs requirements in the country of export and import.
There are variants of ex-works terms, which are available on the International Chamber of Commerce website. For example, under 'ex-works loaded', the seller is expected to load the goods at his premises.
